Please read these Terms and Conditions carefully before using The Learn Skill website and services. By accessing, browsing, or registering on our Platform, you acknowledge that you have read, understood, and agreed to be legally bound by these Terms of Use.

01.Electronic Record & Legal Framework

This document is an electronic record in terms of the Information Technology Act, 2000 and rules made thereunder as applicable, and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.

02. Intermediary Guidelines Compliance

This document is published in accordance with the provisions of Rule 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011, which require publishing the rules and regulations, privacy policy, and Terms of Use for access or usage of the domain name https://thelearnskill.in ("Website"), including any related mobile site or mobile application (hereinafter referred to as the "Platform").

03. Platform Ownership

The Platform is owned and operated by The Learn Skill, represented by its owners Yuvraj Gupta and Md. Shahbaz Ansari(hereinafter referred to as the "Platform Owner," "we," "us," "our").

04.Binding Agreement & Modifications

Your use of the Platform, and the services and tools available on it, is governed by the following terms and conditions ("Terms of Use"), as applicable to the Platform, including any policies incorporated herein by way of reference, including our Privacy Policy. If You purchase a course or otherwise transact on the Platform, You shall be subject to the policies applicable to such transaction. By merely using the Platform, You shall be contracting with the Platform Owner, and these Terms of Use, including the policies referenced herein, constitute Your binding obligations with the Platform Owner.

These Terms of Use relate to your use of our website and the cybersecurity courses and related services made available through it (collectively, "Services"). Any terms and conditions proposed by You which are in addition to, or which conflict with, these Terms of Use are expressly rejected by the Platform Owner and shall be of no force or effect. These Terms of Use may be modified at any time without assigning any reason. It is your responsibility to periodically review these Terms of Use to stay informed of updates.

05. User Definition

For the purpose of these Terms of Use, wherever the context so requires, "you," "your," or "user" shall mean any natural person who has agreed to become a registered user, learner, or buyer on the Platform.

06. Express Notice of Consent

ACCESSING, BROWSING, OR OTHERWISE USING THE PLATFORM INDICATES YOUR AGREEMENT TO ALL THE TERMS AND CONDITIONS UNDER THESE TERMS OF USE, SO PLEASE READ THE TERMS OF USE CAREFULLY BEFORE PROCEEDING.

07. Terms of Use & Service Rules

The use of the Platform and/or availing of our Services is subject to the following specific terms and conditions:

Account Creation & Authenticity: To access and use the Services, you agree to create an account by providing true, accurate, and complete information, including your name, email address, and phone number, either directly or through Google Sign-In, and you shall be responsible for all acts done through the use of your registered account on the Platform. Account access is managed through Firebase Authentication.
7.2
Age & Consent Requirement: You must be at least 13 years of age to create an account and use the Services. If you are under the age of 18, you confirm that you have the involvement and consent of a parent or legal guardian in using the Platform and making any purchases.
7.3
No Warranties or Guarantees: Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness, or suitability of the course content, information, and materials offered on this Platform or through the Services, for any specific purpose, including any certification, employment, or examination outcome. You acknowledge that such information and materials may contain inaccuracies or errors, and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

Use at Your Own Risk: Your use of our Services and the Platform is solely and entirely at your own risk and discretion, for which we shall not be liable to you in any manner. You are required to independently assess and ensure that the Services meet your learning requirements before purchasing a course.
7.5
Intellectual Property & Educational License: The contents of the Platform and the Services, including course videos, materials, text, graphics, logos, and design, are proprietary to us or our licensors. Purchase of a course grants you a limited, non-exclusive, non-transferable license to access the course content for your personal, non-commercial, educational use only. You will not have any authority to claim any intellectual property rights, title, or interest in its contents, and you may not copy, reproduce, redistribute, resell, or publicly share any course content.
7.6
Unauthorized Usage & Credential Sharing: You acknowledge that unauthorized use of the Platform, the Services, or course content (including sharing your account credentials or course access with third parties) may lead to suspension of your account and/or action against you as per these Terms of Use and/or applicable laws.
7.7
Charges: You agree to pay us the charges associated with availing the Services, at the prices displayed on the Platform at the time of purchase.
7.8
Ethical Cybersecurity & Prohibited Conduct: You agree not to use the Platform and/or Services for any purpose that is unlawful, illegal, or forbidden by these Terms, or by Indian or local laws that might apply to you, including using cybersecurity knowledge gained through our courses for any malicious, unauthorized, or illegal activity.
7.9
Third-Party Links & Integrations: You agree and acknowledge that the Platform and the Services may contain links to other third-party websites, including our payment gateway (Razorpay) and authentication provider (Google/Firebase). On accessing these links, you will be governed by the terms of use, privacy policy, and other applicable policies of such third-party websites. These links are provided for your convenience and to enable the Services.
7.10
Binding Contract: You understand that, upon initiating a transaction for availing the Services, you are entering into a legally binding and enforceable contract with the Platform Owner for the Services.
7.11
Indemnification:You shall indemnify and hold harmless the Platform Owner, its affiliates, and their respective officers, directors, agents, and employees, from any claim or demand, or actions including reasonable attorney's fees, made by any third party or penalty imposed due to or arising out of Your breach of these Terms of Use, our Privacy Policy, or other applicable policies, or Your violation of any law, rules, or regulations, or the rights (including infringement of intellectual property rights) of a third party.
7.12
Prohibition of Content Sharing & Anti-Piracy Policy: No course content, video recordings, study materials, or platform assets may be shared, recorded, copied, distributed, or resold in any manner. Any individual caught engaging in piracy, unauthorized sharing, or distribution of platform content will face immediate account termination and strict legal action under the Indian Copyright Act, 1957 and other applicable cyber and intellectual property laws.

08. Force Majeure

Notwithstanding anything contained in these Terms of Use, the parties shall not be liable for any failure to perform an obligation under these Terms if performance is prevented or delayed by a force majeure event.

09. Governing Law

These Terms and any dispute or claim relating to it, or its enforceability, shall be governed by and construed in accordance with the laws of India.

10. Jurisdiction

All disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in India.
